摘要
通过分析遗失人及拾得人之间的法律关系，结合民法基本原理和各国立法经验对现行遗失物的有关规定不足及立法完善进行探讨。这种探讨在我国物权法尚未出台之前具有一定的现实意义。
The article discusses the disadvantage of present law system and advice on perfecting legislation through the law relation between picker and loser and combining civil law fundamental doctrine and legislation experience. The discussion has definite meaning before property law is coming on.
