本文认为 ,社会整体上现代化的最直接表征是经济市场化、政治民主化和法治化。它们是法院制度现代转型必须仰赖的背景资源 ,决定着法院制度现代化的进程。不同国家采取不同的路径践行现代化的法院制度 ,各有其合理性。

Social whole modernization directly indexed by economical market, political democratization and legalization is background resources of transformation of modern court system of default appearance and determined the process of modernization of court system. It is reasonable that different country adopts different way to modernized court system. The paper reviews two ways to modernized court system.
