对占有概念的思考

Thoughts of Concept of Possession

占有是一项古老的民法制度,也是现代民法物权体系中一项特殊的、重要的法律制度。我国民法迄今未对“占有”加以规定。为了完善中国民法典,必须规定相关的占有制度。笔者认为,通过追溯占有的起源,探求占有的发展、演进,明确占有的本质和概念是十分必要的。

Possession is the most ancient Civil Law system as well as a special and important legal system in modern Property Law system of Civil Law. 'Possession' has not been stipulated in the Civil Law In our country. In order to be perfected the Civil Law Dictionary in China,possession system has to be formulated. I thought that it is very necessary to trace back to the origin of possession,explore the development and evolution of possession and make clear the essence, concept of possession.
