Sustainable Development and Chinese Environmental Law Reform:Renovation of the Chinese Environmental Law System

正如可持续发展战略推动着西方国家环境法发展一样 ,我国环境法概念和范畴重新回复到整体环境观和广义环境法以后 ,我国环境法律体系面临重新整合。借鉴西方国家环境法发展的经验 ,重塑我国环境法律体系的途径是 :坚持宪法 -环境基本法 -环境实施法的体系模式 ;坚持并革新《环境保护法》 ( 1 989)使之成为整体环境观下的环境基本法 ;重整以环境污染防治法、自然资源管理法。

In response to theory on integrated enviormental law in China, the current Chinese environmental law system is facing renovation.It suggests that the Chinese environmental law system should be re organized by following up the law frame work of 'constitutional law basic environmental law environmental sector law.Under the environmental law framework, the Chinese environmental law system includes 3 levels of law' (the Constitutional law, the basic environmental law and environmental sector laws). Environmental Protection Law of Peoples Republic of China (1989) should be regarded as the basic environmental law as well during renovation,but it needs a great amendment to meet the role of actually being the basic environmental law of China.There are 4 main branches of sector laws:pollution control laws,natural resource laws, ecological protection laws and environmental administration laws for given events.
