On the beneficial contract for the third man

第三人利益合同是对合同相对性理论的一种突破 ,本身具有独特的制度价值 ,我国合同法对此却未作规定。本文在比较研究的基础上 ,重点论述了第三人利益合同的含义、结构、制度价值、第三人的法律地位、第三人利益合同的效力等内容 ,旨在进一步完善我国的合同法律制度。

The beneficial contract for the third man is a breakthrough to the relative theory of contract,which has its particular systematical value,but the contract law of the People's Republic of China has no such regulations.Based on comparative study,this article is concerned about the connotation,structure,systematical value,effectivity of the beneficial contract for the third man and the law position of the third man,and aimed at the improvement of the contract system of our country.
