夫妻间过错赔偿责任制度探讨

由于人们法制观念的淡薄和传统道德力量的弱化 ,家庭暴力、“包二奶”、“包二爷”、婚外恋、家庭成员间的虐待、遗弃 ,有越来越多的趋势。遏制此种现象 ,制裁行为人 ,不能仅仅依靠刑事制裁措施 ,而要广泛采用民事制裁措施。修正前的婚姻法没有规定民事制裁与赔偿措施 ,新修正的婚姻法虽然规定了过错赔偿责任制度 ,但仍存在诸多缺陷。本文从以下几个方面对此作了阐述 :建立过错赔偿责任制度的必要性 ;夫妻财产约定制 ,为经济赔偿奠定了基础 ;夫妻关系存续期间 ,受害方有权要求加害方予以经济赔偿 ;夫妻间过错赔偿的范围 ;对修正后的婚姻法中“无过错方有权请求损害赔偿”

Because the reduction of the traditional moral force and thin of people's awareness of the legal system,Family violence,'another illegal wife','another illegal husband',the extramarital affair,maltreating or abandonment among kinsfolks,are trending further and further. Suppressing his phenomenon and punishing the people who do this kind of thing, we should not only punish it criminally,but also take the punishing extensively. The new revising,Marriage Law establishes the fault compensating system,but it still has a lot of shortcomings.This paper has explained this form the following respects.Setting up the necessity of the fault compensating system, The agreement system of couple's property, has built up the foundation for economic compensating;when the conjugal relation exists and extends,the injured has the right to require the injuring to give the economic compensation; the rang of the fault compensating,etc.
