摘要
研究了工程移民活动中补偿地价的内涵和具体的计算公式。结合实践分析了对城市国有土地使用者土地使用权补偿和对被征用农村集体土地所有权补偿地价的构成及其表现形式 ,认为 :工程移民活动中的补偿地价的评估既要符合国家的法律法规 ,又要协调国家、集体、业主和个人之间的关系 ,合理调整各方面的利益 ,体现出公正、公平、合理的原则。
The land price for the compensation in resettlement for projects and specific formulas to calculate the land price are discussed.With the combination of practice,the contents of compensation for land using right of state owned land in urban areas and compensation for land property of collective land in rural areas are analyzed.It is suggested that the appraisal of land price for compensation in resettlement should not only be in conformity with state laws and regulations,but also coordinate the relationships among country,collective,project owner and individuals.The relationships of their benefits should be adjusted on the principle of equity and justice.
