行政自由裁量权的滥用是行政职权滥用的主要表现之一。行政自由裁量权的滥用挑战着法律的 权威 ,并使公众逐渐丧失了对法律的信任。这是对实施依法治国的最大威胁。如何贯彻《立法法》精神 ,完善 行政立法工作 ,在行政执法中发挥行政自由裁量权的最大效能并避免其被滥用 ,是本文研究的重点。

The abuse of administrative free decisive right is one of the main expressions of abuse of administrative right,which challenges the authority of law.The public will lose their trust on law,which is the great threat to governing the country in accordance with legal provisions.The purpose of this article is to make research on how to implement the spirit of 'A Provision on Making Law' and make the best of the administrative free decisive right while prevent it from being abused.
