高校管理法治化趋向中的观念碰撞和权利冲突——当前讼案引发的思考

不断出现的高校管理讼案 ,正在成为人们关注的新问题。伴随我国的法治进程 ,高校管理的法治化似已成为一个不以人的意志为转移的发展趋向。本文从高校的内部管理秩序、学术管理与学术权力、高校与学生的特别权力关系、高校管理的基本理念等四个方面 ,对当前高校管理讼案中出现的观念碰撞和权利冲突进行了分析和探讨。剖析了在走向依法治国大环境下我国高校管理工作所面临的挑战及其历史根源、观念因素和发展趋势。揭示出缺少法治的学校管理关系以及那些不符合法治精神的传统观念和旧的行为方式 ,正在被迫经历一场适应整个国家法治发展的深刻变革。

Current cases in college administration are a new problem deserving attention,with the progress of rule by law in China.To legalize the management in college has been an inevitable trend.This article analyzes the concept collision and right conflict initiated by current cases in college from 4 aspects:inner management order,academic administration and academic power,special administrative relationship,basic idea in college management.The author has analyzed its historical source,idea factor,development and challenges,which the college management work of our country is faced with under the large environment of rule by law.This article holds that the college management relationship,as well as those traditional ideas that are inconsistent with the spirit of rule by law and old behavior way have being compelled to and have been to go through a deep transformation that meets the entire national development of rule by law
