沈家本论法制与道德之关系评析

A Study on SHEN Jia-ben's Thought with Contact of the Legal System and the Morality

作为清末一位著名的法学家，沈家本对中西法律学说均有很深的造诣。他对法制与道德的关系进行过深入探讨，认为两者均为治国者所不可或缺，但道德对预防犯罪起着更为重要的作用。另外，执法者的道德素质直接关系到法律的实施，只有良法而无善人执法，良法则形同虚设。沈家本的思考对我们今天建构一种“德治”与“法治”并重的治国模式是有借鉴价值的。

SHEN Jia - ben is a famous jurist in Qing Dynasty. He gained the great attainments in a sphere of the legal thought of China and the West. He probed into contact on legal system and morality. To his opinion, the morality plays more important role than the legal system in the sphere of administering a country. A noble minded person enforces the law, the authority of law is set up. We can draw lessons from SHEN Jia - ben's thought in the legal and moral construction of the modern times.
