论知识产权国际保护中的司法保护

On the Judicatory Protection in International Protection of Intellectual Property Right

与知识产权有关的贸易 ,实际上在国际贸易中占据了很大的比重。尤其是世界知识经济浪潮澎湃的今天 ,任何一种国际贸易都很难说与知识产权无关。知识产权的保护由此也渐渐打破地域性的限制 ,成为一个国际性的话题。而知识产权的国际司法保护作为知识产权保护中一个较为重要的组成部分 ,尤有研究的必要。在介绍知识产权国际司法保护的缘起和体系的基础上 ,重点论述了知识产权法律保护的两种调整方式 ,指出二者必须相辅相成 ,共同发展。

The trade related to intellectual property right takes up a large proportion in international trade. Especially today when the world knowledge economy is at its best, any international trade has something to do with intellectual property right. The protection of intellectual property right, therefore, is beyond the restriction of boundaries and becomes international issue. It is necessary to study the international protection of intellectual property right as it is an important component of intellectual property right protection. Based on the introduction of origin and system of international judicatory protection of intellectual property right, this paper focuses on the discussion of the two adjusting ways for the law protection of intellectual property right, and points out that the two must supplement each other and seek mutual development.
