论法律移植

On the Transplantation of Law

法律移植是法律文化中常见的现象 ,它通常是指特定国家或地区的某种法律规则或制度移植到其他国家或地区。[1] 而在比较法学界 ,法律移植却一直是一个颇有争议的问题 ,这一争议主要不在于法律是否可以移植 ,而在于对法律移植可能性程度的不同估价 ,即如何使移植获得成功 ,如何使移植过来的法律更好地发挥其效用。本文对法律移植理论进行了初步评析 ,论证了法律移植的可行性 。

The transplantation of law is a common phenomenon in the legal culture,which is usually defined as transferring legal rules or systems from certain countries or areas to the others.It is also a disputable issue in the field of comparative law,and the dispute does not lie in whether the law can be copied,but the evaluations of its possibility,that is,how to make the transplantation be successful,how to make the transplanted law take effect better.In this article,the author comments on the theories about them.By analyzing the means of the transplantation of law,she also points out that several problems should be paid attention to.
