试论中国法治的启动

On the initiation of the ruling by law in China

启动中国的法治进程是法治建设系统工程的一个重要方面。中国法治的启动不应主要依靠自上而下的强行推动 ,而应主要依靠自下而上的自然演进。这至少有两方面原因 ,一方面市民社会是法治的真正基础和源泉 ,另一方面中国市民社会的发育是一个漫长的过程。鉴于此 ,我国应坚定不移地进行经济体制改革 ,发展市场经济 ,在思想领域大力普及民主、法制等观念 ,不断提高人民大众的思想觉悟 ,加速市民社会的培育和发展 ,从而推动我国法治进程。

The initiation of the ruling by law plays a vital part in the process of its systematic building.It should not only depend mostly on the government's forceful impetus,but on its natural evolution,because citizen society is the real foundation and source of the ruling by law, and on the other hand,the development of the citizen society calls for a long period.Owing to these,we should unswervingly carry on our economical system reform,develop our market oriented economy and promote the concepts of democracy and law to enlighten the thinking of the public.In this way,we can accelerate the development of the citizen society and the process of ruling by law.
