近代广西司法制度几乎与全国同步地产生和发展于清末民初,但旧桂系时期广西司法制度的执行却明显滞后于全国其它地区。这是因为,作为上层建筑重要组成部分的司法制度,它的执行毕竟要受到各种社会困素的制约:行政权、军权对司法权的于预、乡规民约的取代作用、社会经济的制约、司法人员素质和职业道德的影响。
