摘要
法权意义上明晰、分立的产权是市场竞争的微观基础,经济意义上具体的产权安排是市场竞争的结果。医疗产权改革的根本点在于从制度和法规上塑造分立的产权主体,赋予物质资源、财务资源、人力资源产权主体以自由选择市场舍约的权力,而不在于讨论和设计国有产权的各种实现途径诸如两权分离、股份制、国有民营等经济上产权安排的具体合约形式。
Property rights which have separate and definitely defined juridical rights are the micro - basis of market competition, meanwhile, arranging the property rights comprehensively from economic aspect is the outcome of market competition. The fundamental points of hospital property rights reform are not to discuss and design all kinds of means (such as to separate property from ownership and so on) to realize the state - owned property rights, but to set up separate property right subjects by institutional and juridical means, and endow material resources, financial resources and human power resources with the rights to select market contracts freely.
