本文通过对国家赔偿的性质、赔偿归责原则、赔偿范围、赔偿程序、赔偿义务机关、赔偿数额和精神损害赔偿等问题的法理学思考,指出《国家赔偿法》内在的缺陷与不足。

This article points out some limitations of the State Compensation Law by analysing the character of compensa tion,the doctrine of liability fixation,the limits of compensation,the proc edure of compensation,the compulso ry organ of compensation,the amount of compensation and menta l injury compensation.
