My Opinions on Transferring of Creditor's Rights

对债权转让的理解有三种观点 ,即自由主义、债务人同意主义和通知主义 ,这三种观点各有利弊。债权转让的适用 ,应采取以通知主义为主 ,以债务人同意主义为补充的措施。

There are three different kinds of comprehensive criteria to transfer the creditor's rights. They are the creditor's freedom of transfer, the debtor's agreement on transfer, the creditor's notification of transfer. They have their advantages and disadvantages respectively. In order to overcome their disadvantages, the application of the transfer of the creditor's rights should take the creditor's notification of transfer as the main factor and the debtor's agreement on transfer as the complementary one.
