我国集体林地增值收益分配制度构建探析

Analysis on Institutional Construction for Distribution of Collective Forestland Increment Income in China

农村土地增值收益分配被认为是提高农民财产性收入和保障农民土地正当权益的有效措施,也是得到管理层和学术界关注的一个热点问题。作为一种特殊的农村土地,集体林地增值收益分配的相关研究鲜见。文章首先梳理了集体林地增值收益分配概念和特殊性,进而分析了集体林地增值收益分配制度的必要性和可行性,从基本原则、农民主体性、增值收益来源、分配机制和分配方式5个方面进一步探析了如何构建此项制度。最后讨论了确保制度得以构建的保障措施。

Distribution of rural land increment income is regarded as an effective measure to enhance farmer’income of property and guarantee farmers’ legitimate interest, which is one of the most popular issues focused by management and academia. Though collective forestland is a special type of rural land, there are a few relevant studies about distribution of collective forestland increment income. This paper started with discussion of definition and special characteristics of distribution of collective forestlands increment income,described that necessity and feasibility to formulate institution of distribution of collective forestland increment income, and then explored arrangement of the institution, which should consist primary rule, farmer subjectivity, sources of increment income, distribution mechanism, and distribution ways. This paper ended with discussion of how to ensure the institution to be formulated.
