检察机关贯彻修改后刑事诉讼法的若干问题

Special Manuscript—Guidance Lecture on the Amendment of Criminal Procedure Law Several Issues on the Procuratorate Implementing the Amended Criminal Procedure Law

2018年10月26日,十三届全国人大常委会第六次会议通过了《关于修改〈中华人民共和国刑事诉讼法〉的决定》,于当日公布施行。这次刑事诉讼法修改充分体现了贯彻习近平新时代中国特色社会主义思想和党的十九大精神,是落实党中央关于深化国家监察体制改革,深化司法体制改革,推进国家治理体系和治理能力现代化的重要举措。修改涉及人民检察院侦查职权的调整、与监察委员办案程序的衔接、认罪认罚从宽制度、刑事缺席审判制度等多项与检察机关密切相关的内容,对检察工作有重大影响,需要检察人员正确理解和适用。各级检察机关要认真贯彻修改后刑事诉讼法,规范行使检察权,履行好法律赋予检察机关的各项职责,推动新时代检察工作创新发展。

On 26th August,2018,the 6th meeting of the Standing Committee of the 13th National People's Congress passed the Decision to Amend the Criminal Procedure Law of the People's Republic of China,which became effective immediately.The amendment sufficiently presents the Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era and the Guiding Principle of the 19th National Congress of CPC.It responds to the Central Party's arrangements on establishing the Supervision Committee,deepening the judicial system reform,and modernizing the state's governance system and govenance capability.The amendment concerns with many contents closely related to the procuratorate,such as the adjustment of the investigation power,the connection with the Supervision Committee,the legislation of the system of plea for leniency,and the addition of the default trial.They have great impact on the procuratorate's work,and should be comprehensively understood and correctly applied.The procuratorate at all levels should practice the amended criminal procedure law well,normatively exercise the procuratorial power, rightly implement the tasks and duties regulated by law,and push forward the new development of the procuratorial work in the New Era.
