党的十九大正式宣告了习近平新时代中国特色社会主义思想的形成,而全面依法治国就是其中的重要内容。在全面推进依法治国的过程中,法学界也应该对马克思主义法学的中国化或曰马克思主义法学学科的构建进行回应和推进。我们必须立足中国实践,走马克思主义与中国社会实践相结合的道路,形成新时代下具有中国特色的马克思主义法学学科。对此,马克思主义法学话语权的发展与勃兴就是当前必须解决的一个问题。我们必须坚持马克思主义对于法学研究和法学教育的指导地位,树立对马克思主义法学的理论自信,打造马克思主义法学话语权体系,修正膜拜西方理论的倾向,淡化并消除对海外经验的迷信,实现对西方法学理论和法学研究范式的超越。

The 19th CPC National Congress officially proclaimed the establishment of Xi Jin-ping Thought on Socialism with Chinese Characteristics for a New Era, with the comprehensive rule of law as an important part of it. In the course of promoting the rule of law in an all-round way, the jurisprudential circles shall also respond to and promote the sinicization of Marxist jurisprudence or the construction of Marxist jurisprudence. We shall base ourselves on Chinese practice and take the road of combining Marxism with Chinese social practice to form a Marxist jurisprudence discipline with Chinese characteristics in the new era. In this regard, the development and prosperity of the discourse right of Marxist jurisprudence becomes a pressing issue that needs to be dealt with at present. We shall uphold the guidance of Marxism in legal research and legal education,build up theoretical confidence in Marxist jurisprudence, and establish a system of Marxist jurisprudence discourse; we shall also revise the inclination of worshiping western theories, dilute and eliminate the superstition of overseas experience, and realize the transcendence of western legal theories and their paradigm.
