社区矫正中止制度的构建

在数年的社区矫正试点及全国全面试行过程中,积累了丰富的司法实践经验,也暴露出了诸多问题。《社区矫正实施办法》只规定了适用社区矫正终止的相关情形,只考虑了社区矫正执行过程中可能出现的具有确定法律后果或结果的情形,未明确适用社区矫正中止的法定事由。但在司法实践中,已然出现需要适用社区矫正中止的具体案例。构建并完善社区矫正中止制度,解决在社区矫正实践中面临的规范适用模糊等问题,是社区矫正立法应加以关注的。

In the course of several years of community correction pilot and national comprehensive trial,we have accumulated abundant judicial practice experience and exposed many problems. The Implementation Measures of Community Correction only stipulates the relevant circumstances of the termination of community correction,only considers the possible situations with definite legal consequences or results in the implementation of community correction,and does not explicitly apply the legal reasons for the suspension of community correction. However,in judicial practice,there are specific cases that need to be applied to suspension of community corrections. Constructing and improving the suspension system of community correction and solving the problems of vague application of norms in the practice of community correction should be paid attention to in the legislation of community correction.
