买方卡特尔的反垄断法规制

The Anti-monopoly Regulations of Buyer Cartels

买方卡特尔在实现规模经济,提高市场效率的同时,也会扭曲市场竞争,损害消费者利益,因而买方卡特尔适用反垄断法中的合理原则。法律主要从买方卡特尔在上下游市场中所具有的市场地位以及它所造成的竞争后果两个方面来进行竞争评价。在制度安排上,反垄断法区分了价格卡特尔和非价格卡特尔两种类型,对前者较为严厉,对后者则显现得较为宽松。我国相关制度对此规定得较为模糊,应当明确界定买方卡特尔与合法团体采购之间的界限。

While the buyer cartels achieve economies scale and improve market efficiency,it will also distort com: petition and harm consumers'interests.Therefore,the buyer cartels are in accord with the reasonable principle of the anti-monopoly law.The competition evaluation of the buyer cartels is mainly carried out in two terms,including its market position in the upstream and downstream markets and the competitive consequences it causes.In the system arrangements,the anti-monopoly law distinguishes between the price cartel and the non-price cartel,with conditions for the former more stringent than for the latter.China's relevant system is relatively vague on this regulation,and the boundary between the buyer cartels and the legitimate group procurement should be clearly defined.
