论我国成年人意定监护监督制度的构建

On Construction of Intentional Monitor and Supervision System for Adults in China

人口老龄化浪潮席卷而来,《民法总则》确立的成年人意定监护制度是解决此难题的有效手段之一。但是缺乏监督的意定监护制度必将对其发展带来阻碍,也满足不了社会需求。我国现行监护监督制度存在不足,需要借鉴国外关于意定监护监督法律制度的经验,来构建我国的意定监护监督制度。

The wave of population aging has swept over.The adult-specific guardianship system established by the General Principles of Civil Law is one of the effective means to solve this problem.However,the lack of supervision of the intended guardianship system will certainly hinder its development and will not meet the needs of society. The shortcomings of China's current monitoring and supervision system need to refer to the foreign legal system experience of the intentional guardianship supervision,in order to build China's intentional monitoring and supervi- sion system.
