论司法公正的法律认同与社会认同

On the Legal Rationality and Social Rationality of Judicial Justice

从社会舆论的角度看,一味强调形式理性法并不能实现民众认可的实质正义,因此固守法律并不能真正实现司法公正。法律作为一种特殊的社会规范固然重要,但是同时也需要考量司法公正的社会认同标准,不然就可能产生民众对法律的逆反。探讨司法公正的法律认同与社会认同,本质上是为了解决司法在形式理性和实质理性之间如何平衡的问题。

From the perspective of social public opinion,insisting the rational method can't realize the substantial justice of public recognition,so sticking to the law doesn't truly achieve judicial justice,the law is important as a special social norms,it also need to consider justice standard of social identity at the same time,or it may bring converse feeling to people.Discussion of legal identity and social identity of the law justice is in essence to solve how to balance between formal rationality and essential rationality.
