摘要
用益物权是既古老而又鲜活的物权制度。在社会经济不断发展的时代背景下,物的利用对人们日益重要,用益物权逐渐成为物权法的中心,在市场经济的舞台上发挥着举足轻重的作用。虽然我国《物权法》将用益物权作为单独篇章进行了较为科学的制度安排,但其与我国现阶段市场经济发展需求相比仍显滞后。我国应当继承传统的典权制度,规范地上权,完善分层地上权,增加居住权,细化特许物权等法律规制,以整合我国用益物权体系的维度定位。
Usufructuary right is an ancient and vivid system of real right. Under the background of the continuous development of social economy,the use of things is becoming more and more important to people. Usufructuary right has gradually become the center of real right law and plays an important role on the stage of market economy. Usufructuary right is regarded as a separate right in the Property Law of China. Chapter Ⅱ carries out a more scientific institutional arrangement. However,the demand for market economy in China is still lagging behind. We should inherit the traditional pawning right system,standardize the superficies,perfect the layered superficies and increase the superficies. The right to residency should be refined,such as chartered real right,and so on,so as to integrate the dimensions of our usufructuary right system.
