控规调整的“必要性”内涵与方法辨析--以美国“区划变更”为借鉴

Analysis on the Connotation and Method of "Necessity" of Regulatory Plan Adjustment:US “Zoning Variance” as a Reference

控规调整的"必要性"应是决定一项调整能否被准许的关键条件之一,对调整的必要性进行论证与审查具有积极的理论与实践意义。然而,一直以来,不论是控规调整的相关研究,还是全国各地的制度安排和管理实践,对控规调整必要性问题的关注都十分有限,这是造成控规调整现象泛滥并产生广泛消极影响的重要原因之一。所以,本文从控规调整的"必要性"内涵与作用入手,借鉴美国"区划变更"中的"困难检验"方法,探讨适合于我国控规调整必要性的审查思路与方法。

The "necessity"of regulatory plan adjustment shall be one of the key determinants for its approval.It is of positive theoretical and practical significance to demonstrate and examine this necessity.However,limited attention has been paid to the "necessity"of regulatory plan adjustment both in its related research and in the institutional arrangements and management practices across the country,which has contributed mostly to the proliferation of this adjustment and the widespread negative impact thereof.Therefore,starting with the connotation and effect of the necessity of the regulatory plan adjustment,this paper explores the thought and method for examining this necessity by drawing on the "hardship test"method in the US "zoning variance".
