藏汉双语法治人才培养机制及其改革研究

摘要 法治人才是实现民族区域自治法治化的法治保障,藏汉双语法治人才队伍建设具有重大的政治意义和司法意义。藏汉双语法官培训和高校藏汉双语法律人才培养,从在职培训和学校教育两个路径,协同回应民族地区双语法治人才短缺所带来的边疆及民族地区司法问题。高校法学教育乃是法治人才培养的主要路径,通过对某综合类民族高校法学院藏汉双语学生培养过程的调查研究发现。双语师资匮乏、授课主体与客体间的藏语错配等约束事实的客观存在,极大地影响了藏汉双语法学专业教育的绩效。藏汉双语法学教育需要在平衡民族地区对司法实践人才.特殊性需求与法学教育一般性要求的理念下,通过严格准入,厘清培养目标,适当增加法学必修课程的学时,并重视发挥培养对象内部的“传帮带”功能等方式提升藏汉双语法治人才培养质量。 Legal talent is guarantee to .the realization of the rule of law in ethnic regional autonomy.The construction of Tibetan-Chinese bilingual rule of law talent has great political and judicial significance.Tibetan-Chinese bilingual judges'training and the cultivation of Tibetan-Chinese bilingual legal talent in colleges'and universities can be carried out from on-the-job training and school education.It can solve the judicial problems in the frontier and ethnic areas brought about'by the shortage of bilingual rule of law talent in ethnic areas.Legal education in colleges and universities is the main path for the cultivation of rule of law talent.We have conducted research on the cultivation process of Tibetan and Chinese bilingual students in a comprehensive national colleges and universities.The authors find that a series of problems in teaching such as the lack of bilingual teachers,the mismatches between the bilingual teachers and students greatly influence the performance of Tibetan-Chinese bilingual legal education.Tibetan-Chinese bilingual legal education needs to balance the special needs of judicial practice personnel with the general requirements of legal education in the ethnic minority areas,through strict access,clarification of the training objectives, appropriately increase of the hours of compulsory law courses,and attention to the internal training "teaching,helping and guiding"function and other methods enhance the quality of Tibetan and Chinese bilingual rule of law talent.
