日本教育基本法修改中的法理论

摘要 日本在发展中经过坚持不懈的努力而构筑起来的民主的、文明国家的同时,力图为世界和平及人类福祉的提高而做贡献。为了实现这一理想.希望培养尊重个人尊严、追求真理和正义、尊重公共精神、具有丰富的人性和创造性。同时,为推进以继承传统和创造新文化为目标的教育,依照日本宪法的精神全面修改了教育基本法。本文从教育目标法修改中的法理论、事业扩大法修改中的法理论和教育行政法修改的法理论三个方面分析了日本教育基本法修改中体现的法理论。 As a democratic,civilized country,Japan has built through unremitting efforts in its development.Japan tries to contribute to the improvement of world peace and human well-being.In order to realize this ideal,Japan hopes to cultivate respect for personal dignity,the pursuit of truth and justice,respect for the public spirit,and rich humanity and creativity.At the same time,in order to promote education aimed at inheriting tradition and creating new culture,Japan has completely revised the Basic Law of Education in accordance with the spirit of the Constitution of Japan.The article analyzes the legal theories embodied in the revision of the Japan's Basic Law of Education from the three aspects:the legal theories in the revision of the educational goal law,the legal theories in the.revision of the career expansion law,and the legal theories in the revision of the administrative law of education.
