论警察执法中公平正义的实现——以社会冲突为背景

Implementation of Fairness and Justice in Police Law Enforcement——on the Background of Social Contradictions

转型期的中国,社会矛盾复杂,利益诉求多元,如何妥善处理各类矛盾纠纷,如何回应人民群众对警察执法公平正义的期待,是当前警察执法面临的新任务。本文从公平正义的蕴涵入手,提出以人民群众是否满意为标准的可感知公正观,以此为前提,指出社会冲突背景下警察执法公平正义所面临的挑战,并从正确处理服务人民与执法公正的关系、整体公平正义与局部公平正义之间的关系、公平正义的执法传递与群众感知的关系等方面提出警察执法公平正义的实现途径。

Complex social contradictions and diverse interests demands are emerging in the transitional period in China.Under such a background,the solutions to deal with various disputes properly and live up to people's expectations timely become new missions in the police law enforcement.Taking the connotation of fairness and justice as premise,the paper proposes a concept of appreciable fairness,which is judged by the satisfaction of people. It points out what challenges faced by law enforcement in the context of social contradictions,and the approaches to keep fairness and justice enforcement should balance the relationship between serving people and fair enforcement, overall fairness and partial fairness,as well as law implementation and mass appreciation.
