农地征收补偿与增值收益分配关系探讨

农地征收是在中国城乡发展过程中关系到农民利益的重要问题。探索创新农地非农化征收中土地增值收益分配机制,协调国家、集体和农民之间的利益关系,以保障农民获得长期稳定的土地增值收益具有重要意义。现阶段,我国农地征收补偿主要通过财产补偿、安置补助和土地补偿三种形式进行。但征地补偿安置方式不同,参与分配的份额、分配的途径及其效果也具有显著的差别。可通过将征地区片综合地价按其功能细化、将政府投入的征地成本内部化等措施显化征地补偿费中的土地增值收益份额,以及通过提高征地补偿标准并将其法定化,分离社会保障费用和对失地农民实行"即征即保"等途径实现征地增值收益的合理分配。

Farmland expropriation is an important issue related to the income of farmers in the process of urban and rural development in China. It is of great significance to explore the distribution mechanism of land appreciation in the process of farmland expropriation,and to coordinate the interests of the state,the collective owners and developers to ensure that farmers obtain long-term stable land appreciation income. At this stage, the compensation for agricultural land acquisition in China is mainly carried out in three forms:property compensation,resettlement subsidy and land compensation. However,the compensation and resettlement methods for land expropriation are different. And the share of participation,the route of distribution,and the effects thereof are also significantly different. Land appreciation distribution in the land acquisition compensation fee can be manifested by measures such as refining the comprehensive area land price and Internalizing the land acquisition cost of government. Besides,increasing and legalizing the land acquisition compensation standard,separating social security costs,and "immediate insurance"for land-losing farmers will be reasonable approaches of land appreciation distribution.
