农村集体建设用地入市改革:基本导向、认识误区与未来趋势 被引量:7

The Marketalization Reform of Rural Collective Construction Land: the Basic Orientation,Cognitive Misunderstandings and Future Trends

摘要 推动农村集体建设用地入市是全面深化改革中致力于重塑“城乡融合”格局、建设城乡建设用地同权同价体制的重大战略举措。但在目前的改革实践中,还存在着诸多认识上的误区,如土地私有化论、用途管制无效论、市场交易自由论、征地制度无用论等,要消除这些认识误区,改革必须坚持城乡地权统一、市场统一和土地用途管制统一的三个基本导向,在积极探索“三块地”联动改革的基础上,逐步从经营性建设用地扩围到宅基地乃至整个集体建设用地入市,并谨慎处置“小产权房”和“城中村”等历史遗留问题。 Promoting the marketalization of rural collective construction is the major strategic measure to commit to reshaping the pattern of "urban-rural integration"and building a system of equal right and equal price for urban and rural construction in deepening reform all around.However,there are still many cognitive misunderstandings in current reform practice,such as land privatization theory,invalidity of use control theory,free market transaction theory,uselessness of land expropriation system theory,etc.To eliminate these misunderstandings,the reform must adhere to the three basic orientations of urban and rural land rights unification,market unification,and land use control unification. On the basis of actively exploring the "three blocks of land"linkage reform,land marketalization expands from the commercial construction land to the homestead and even the entire collective construction land with carefully disposing of historical issues such as "limited property houses"and "villages in the city".
