商事仲裁改革国际潮流下的加速仲裁程序

Expedited Proceedings under the International Trend of Reform of Commercial Arbitration Procedure

晚近针对仲裁诉讼化的严重后果,世界各仲裁机构纷纷启动仲裁程序改革、推出加速仲裁程序,开启了商事仲裁程序改革创新的国际潮流。在快速低费仲裁目标的指引下,各仲裁机构进行了一系列卓有成效的程序改革。在深入开展国际交流和竞争中,各仲裁机构的加速仲裁程序呈趋同化和个性化发展。多年来,中国在探索商事仲裁程序改革、加速和完善仲裁程序方面已有较大进展,但与国际实践相比仍有不足,可借鉴国际经验继续推进和深化。

In response to the severe consequences resulting from the judicialization of arbitration,more and more arbitral institutions initiated reform of arbitration procedure and adopted expedited proceedings,hence an international trend of reform of commercial arbitration procedure arose.Guided by the goal of fast and low-cost arbitration,the arbitral institutions conducted a series of effective procedure reforms.Through in-depth communication and competition,the expedited proceedings of different arbitral institutions present a trend of convergence and individuation.Over the past years,China have got great achievement in reforming and speeding up the arbitration proceedings,but it is far from satisfactory.Therefore,it should be further improved by drawing experience from international practice.
