为破解我国开放政府数据价值释放与风险管理平衡难题,进行科学理性的顶层设计。通过文献调研、归纳演绎、案例分析等方法逐层推进,提出合理配制政府开放运动中各利益相关方的权责可以实现开放政府数据价值释放与风险管理的平衡,也是制定中国政府数据开放许可协议的关键所在。文章阐述了制定中国政府数据开放许可协议的理论依据,提出政府数据开放亟需制定以免费为原则的数据定价政策和三级数据开放政策等理念,并论证了五层数据定价体系和豁免清单等制定过程,最终研制出中国政府数据开放许可协议的文本框架。

To solve the balance problem of value release and risk management in open government data in our country, we need to carry out the top-level design scientifically and rationally. Through literature review, induction and deduction, case analysis and other methods, the paper puts forward that allocating the rights and responsibilities of all stakeholders rationally in the government’s open campaign can achieve a balance between the data value release of open government and its risk management, and be the key to developing Chinese Licence for Open Government Data.The paper explains the theoretical basis for the development of Chinese Licence for Open Government Data, puts forward the idea that the government urgently needs to develop a data payment policy with the principle of free, a three-level open policy, etc., demonstrates the development process of a five-tier data payment system and an exemption list, and eventually develops the text frame of Chinese Licence for Open Government Data.
