依规治党之“规”的外延研究——兼论党内法规制度建设应坚持的三大思维

On the Rules of Rule-Based Governance over the Party——Currently on Three Important Thinking in Inner-Party Rules and Regulations Building

依规治党是依法治国的必然要求与重要保障。在理解和把握依规治党时必须立足于狭义的角度上,不能将其宽泛地解释为依据党的规矩治党,否则会降低了依规治党的要求,且会冲击现有的法治理论体系,使现行的治党理论产生混乱。依规治党之"规"是专指党内法规,而不包括国家法律、社会规范等其他党的规矩。加强党内法规制度建设,是全面从严治党、依规治党的必然要求。为此,需要运用法治思维、系统性思维以及协同化思维在内的三种思维,全面加强党内法规建设。

Rule-based governance over the Party is the inevitable outcome and powerful guarantee of the rule of law. The understanding and grasp of rule-based governance over the Party should be established in the narrow sense and thus the governance shouldn’t be explained extensively as the governance by Party rules. Otherwise, it will lower the requirements of rule-based governance over the Party, impact the existing theory system of the rule of law, and result in the confusion of the current theory of Party governance. The rule of rule-based governance over the Party refers specifically to the inner-Party rules and regulations, which doesn’t include other Party rules as state law, social norms and so on. Strengthening the building of innerParty rules and regulations system is the inevitable requirement of exercising full and rigorous governance over the Party as well as rule-based governance over the Party. In this respect, it is necessary to make use of three kinds of thinking, such as the thinking of the rule of law, systemic thinking and synergetic thinking into comprehensively strengthening inner-party rules and regulations construction.
