摘要
理论界对人工智能的担忧大多来自于其对劳动力市场和就业结构的冲击,以及由此带来的劳动法主体变革、功能萎缩问题。技术进步与就业关系的相关理论以及我国近年来的劳动力市场变化的实证数据,证明科技革新与劳动力是可以互补的,技术进步并非失业的"罪魁祸首"。审视劳动法的价值取向,发现人工智能的应用与劳动法律主体资格、主体价值、劳动自由理念并不完全冲突。积极就业效果取决于合理制度的建立,劳动法可以利用技术进步影响的阶段性,有效应对人工智能背景下劳资对比力量、劳动力市场需求变化带来的挑战,适时转变劳动关系的调整重心,加大就业促进政策,强调企业社会责任,使科技革新下的劳动者能够共享人工智能的成果。
Most of the concerns about artificial intelligence come from its impact on the labor market and employment structure,as well as the resulting changes in the main body of labor law and the shrinking function.By studying the relevant theories of technological progress and employment relations and the empirical data of labor market changes in recent years in China,it is proved that technological innovation and labor can complement each other,and technological progress is not the"culprit"of unemployment.Examining the value orientation of labor law,it is found that the application of artificial intelligence is not completely in conflict with the labor law subject qualification,subject value,and labor freedom concept.Research shows that the effect of active employment depends on the establishment of a reasonable system.Labor law can take advantage of the stage of technological progress,actively respond both to the challenges brought about by the contrast between labor and capital in the context of artificial intelligence,and to the changes in labor market demand,besides,it can adjust the focus of labor relations in a timely manner,and increase employment promotion policies and emphasize corporate social responsibility so that workers under technological innovation can share the fruits of artificial intelligence.
