摘要
代言虚假广告具有严重的社会危害性、刑事违法性和应受刑法惩罚性,但却因为《刑法》对虚假广告罪的主体进行了限定,因而导致追究广告代言人承担刑事责任在立法中缺失。虽然共犯理论可以作为虚假广告代言人承担刑事责任的法理依据,但在司法实践中操作起来却很困难。因此,应当在虚假广告罪的主体中增加广告代言人,完善虚假广告罪的定罪量刑标准、完善相关法律法规,让消费者的合法权益得到更加有效的保护、广告业更加有序发展。
Endorsing false advertising has serious social harmfulness and criminal illegality,and it should be subject to criminal penalty.However,the subject of false advertising crime is limited by the Criminal law,whichleads to the lack of criminal responsibility of advertising spokesmen in legislation.Although the theory of accomplice can be used as the legal basis for false advertising spokesperson to bear criminal responsibility,it is difficult to operate in judicial practice.Therefore,we should add advertising spokesperson to the main body of the crime of false advertising,improve the conviction and sentencing standards of the crime of false advertising,and improve relevant laws and regulations,so as toeffectively protectconsumers’ legitimate rights and interests,andtoensure the orderlydevelopment ofthe advertising industry.
