China's Path of Sports Legal Construction in 40-Year Reform and Opening Up

改革开放40年来,伴随着政治民主化、经济市场化以及现代国家治理,法治的作用日益受到重视,体育法治建设也在探索中前行,形成了体育政策与体育法治交融,体育理论与体育实践互动,奥运争光与全民健身并进的体育发展特点。形成了反映和体现党对体育工作的领导和党的体育政策法治化要求、以人民为中心的中国特色社会主义要求、创新精神和与时俱进的改革要求、体育事业发展和依法治体的法治要求、借鉴人类法治文明成果的体育国际化要求的中国特色社会主义体育法治建设道路、制度和理论。回顾和总结40年来我国体育法治建设的发展,提炼体育法治建设的中国特色与经验,把握中国特色体育事业发展规律,探索中国特色体育法治建设道路,坚定中国特色体育事业发展和体育法治建设的道路自信、理论自信、制度自信和文化自信,迎接新时代中国体育改革深入发展和体育法治建设的进一步完善。

In the past 40 years of reform and opening-up,along with political democratization,market-oriented economy and modern state governance,the role of rule of law has been paid more and more attention,and the construction of rule of law in sports is also on the way of exploration,it has formed the integration of sports policy and rule of law in sports. The development of sports has formed the interaction between sports theory and sports practice,and the characteristics of winning the Olympic Games and promoting fitness for all. The road,system and theory of the socialist sports rule of law with Chinese characteristics have been formed,which reflects and embodies the Party’s leadership in sports work and the requirements of the Party’s sports policy for the rule of law,the requirements of socialism with Chinese characteristics centered on the people,the innovative spirit and the reform requirements of keeping pace with the times,the development of sports undertakings and the requirement of rule of law for governing sports according to law,and draws lessons from the sports internationalization requirement of the achievements of human civilization governed by law. This paper reviews and summarizes the development of sports rule of law in China in the past 40 years,extracts the Chinese characteristics and experience of sports rule of law construction,grasps the development law of sports with Chinese characteristics,explores the road of sports rule of law construction with Chinese characteristics,strengthens the road self-confidence,theoretical self-confidence,system self-confidence and cultural self-confidence of the development of sports cause with Chinese characteristics and sports rule of law construction,and welcomes the further development of sports reform in China in the new era and the further improvement of sports rule of law construction.
