法治文化认同:人的革新与寻根

On Culture Identity of The Rule of Law : Human Innovation and Root-seeking

法治文化认同是当代中国法治实践中最值得关注的问题之一。认同是关于人的本质的人的自我同一性,关涉"我是谁"、"我们是谁"等问题。法治文化认同是法治文化实践中人的同一性问题,解答了人在多元文化下的法治实践中如何看待"我是谁"、"我怎样做才是我"的法治自我认同。以人为主体存在为视角审视中国的法治进程,发现虽然国家主导的法治模式完成了制度建设,而大众缺乏对制度之上的观念认同;急速的现代化进程造成了人的情感和理性的断裂。因此,要实现法治文化认同应始终围绕两大主题:人的革新与人的寻根,应以人为主体在中国的法治实践中不断地通过革新和寻根的方式来实现认同。

Culture identity of The Rule of law is one of the most worthy issues in the practice of rule of law in contemporary China.Identity is about the nature of human beings,and concerns about who I am and who we are.Culture identity of The Rule of law Is the Issue in the Practice of The Rule of law culture.It concerns about " who am I" and " what do I do is" in the rule of law practice under multiculturalism.Taking the human as the main body to examine China’s rule of law process,it is found that although the state-led rule of law model completes the system construction,the public lacks identity of The Rule of law;the rapid modernization process has caused the break of emotion and reason.Therefore,to achieve the rule of law cultural identity should always focus on two major themes: human innovation and human root-seeking,people should be the main body in the rule of law practice in China through innovation and root-seeking way to achieve identity.
