英国“规制沙盒”对我国金融创新与风险防范的启示

The Enlightenment of "Regulatory Sandbox" in Britain on China's Financial Innovation and Risk Prevention

"规制沙盒"是由英国的金融行为监管局所提出并在实践中推行的监管理念,体现申请测试的灵活性、注重弹性监管的豁免机制、发展理念的一致性、获得个性化的指导意见等特征,且凸显事前介入、弹性灵活的双重逻辑。我国引进"规制沙盒"的理念有助于转变金融科技监管模式、推动金融创新与金融监管的平衡、保护金融消费者的相关权益、健全金融科技风险防控体系。在推动"规制沙盒"理念本土化的过程中,我国必须重视伴随金融创新而生的诸多挑战,且因时制宜、因地制宜的产生与我国金融可持续发展相适应的国情监管思维和监管定位,从而强力推动金融的可持续创新,最终实现金融创新和风险防控的双重目的。

Regulation sandbox is put forward by Britain’s financial behavior supervision bureau and implement regulation theory in practice,embodying the flexibility of application test,paying attention to the exemption of flexible regulation mechanism,the development idea of consistency,get personalized features such as guidance,and highlight prior intervention,elastic flexible dual logic.The introduction of the concept of sand box regulation in China will help transform the fintech supervision mode,promoting the balance between financial innovation and financial supervision,protecting the relevant rights and interests of financial consumers,and improving the fintech risk prevention and control system.In promoting the sandbox concept in the process of the localization of rules and regulations,our country must pay attention to with financial innovation and challenges,to adjust measures to local conditions and adapting to the sustainable development of China’s financial supervisory and regulatory orientation of thinking.On this basis,governance should be carried out from the aspects of establishing clear fintech development strategies and regulatory policies,continuously innovating financial regulatory tools and shaping trans-regional cooperation mechanisms.
