公权力的异化与回归

Dissimilation and Regression of Public Power

公权力的产生源于私权利,目的是为保护公共利益,但公权力在其发展过程中发生了异化,现代法治的核心之一就是对公权力的制约。目前公权力异化主要表现为公权力寻租现象突出、范围无限扩张、行使程序不正当、对私权利的无视与侵犯等。公权力的异化不仅导致其权威性降低,而且造成资源和公共利益受损。法治建设的过程是公权力的回归过程,其有赖于权力的下放与监管、公权力行使者法治理念的树立、公民法治意识的提升及规则秩序的确立等。

Pubhc power generates from private rights,and its purpose is to protect the public interest.There oc- curs dissimilation in its development,but one of the core of modern law is the restriction to public power.Dissimilation of public power manifests as power rent-seeking,disregard of private rights and infringement,unlimited expansion of scope and undue exercises.Dissimilation of public power leads to the damage to its authority,resources and public interests.The construction of law is in fact the process of public power regression which relies on the devolution of power and supervision,the establishment of legal mind,the promotion of citizens"consciousness of law,and the build-up of rule of order.
