司法职业性与平民性的双重标准——兼论司法改革与司法评估的逻辑起点

Double Standards of Judicial Professionalism and Civilianism——on the Logical Starting Point of Judicial Reform and Judicial Evaluation

近20年来司法改革思路的根本性分歧在于司法的职业性和平民性之间固有矛盾的冲突。从新中国成立后的多次司法改革来看,大致都是在司法职业性和司法平民性之间的选择。司法公信力作为司法改革的一个目标,同样包含着这对固有的矛盾关系。如何处理好这对矛盾?既关系到改革的顶层设计与举措的合理配置,同时也关系到司法评估中如何兼顾职业性和平民性的双重标准。本文旨在揭示司法改革和司法评估的逻辑起点——职业性和平民性的均衡兼顾。

The fundamental conflict in the judicial reforms in the past 20 years lies in the inherent contradictions between the professionalism and the civilianism of the judiciary. Judging from several judicial reforms since the 1950 s, it is roughly a choice between judicial professionalism and judicial civilianism. As a goal of judicial reform, judicial credibility also contains this inherent contradiction. How to deal with this contradiction? It is related to the rational allocation of reform measures, but also to the double standards of professionalism and civilianism in judicial evaluation. This paper argues that it is necessary to find the logical starting point of judicial reform and judicial evaluation, which is the balance between professionalism and civilianism.
