摘要
《中华人民共和国香港特别行政区基本法》第十八条规定,列于附件三的全国性法律由香港特区公布或立法实施。与公布实施相比,香港特区立法实施香港基本法附件三所列全国性法律引发了更多关注和讨论。有关讨论聚焦于特区立法机构应当如何进行适应化立法,既落实香港基本法第十八条所规定的宪制义务,又确保该本地立法不违反香港基本法有关居民基本权利的规定。
Article 18 of the Basic Law of the Hong Kong Special Administrative Region of the People's Republic of China stipulates that the promulgation-or legislation-based application of the national laws listed in Annex Ⅲ shall be in the charge of the Hong Kong SAR.Compared with the promulgation-based application,the legislation-based application by the Hong Kong SAR of the national laws listed in Annex Ⅲ to the Basic Law ofHong Kong has raised more attention and discussions.These discussions focus on how the SAR legislature should handle adaptive legislation in a way which ensures that the constitutional obligations set out in Article 18 of the Basic Law ofHong Kong are fullfiled and that the local legislations do not contravene the provisions on basic rights of residents under the Basic Law ofHong Kong.
