刍议针对市场混淆行为的反不正当竞争法规制

On the Regulation of Law of the People's Republic of China for Countering Unfair Competition on Mixed Behavior in the Market

在市场经济迅猛速发展的背景下,作为典型的不正当竞争行为之一的市场混淆行为逐渐呈现出复杂化、多元化的态势,对市场秩序造成的破坏程度以及危害性不断加深,而我国《反不正当竞争法》对市场混淆行为的法律规制仍需完善。本文基于以上现状对市场混淆行为进行概述,通过立法、执法、司法三个环节对市场混淆行为的反不正当竞争法规制进行审视并予以评析,并在文末对规制的完善做出构想,从而进行系统研究针对市场混淆行为的反不正当竞争法规制问题。

Under the background of the rapid development of market economy,as one of the typical unfair competition behaviors,the mixed behavior in the market has gradually become complicated and diversified,and the damage degree and harm to the market order have been deepened. However,Law of the People’s Republic of China for Countering Unfair Competition still needs to be improved for the regulation on the mixed behavior in the market. Based on the analysis of the above phenomena,this paper summarizes mixed behavior in the market,reviews and analyzes the mixed behavior in the market through three links: legislation,law enforcement and justice. In the end,this paper makes hypothesis for the perfection of regulation to conduct a systematic study on the regulation of Law of the People’s Republic of China for Countering Unfair Competition on mixed behavior in the market.
