摘要
民族教育法建设是我国教育建设的重要组成部分,更是社会发展的重点领域。民族教育法作为少数民族教育的基本法,可以为少数民族制定相关的民族教育法律、法规提供理论依据。随着社会关系不断多样化,我国法律部门体系日益复杂,法律部门不断细化,同时出现兼有不同法律部门特色的新领域,其中民族教育法地位问题成为当前学者讨论的热点。目前,民族教育法在民族地区传统法律部门中的地位有隶属说、独立说两种主流观点,为更好实现民族教育法地位问题在传统法律部门理论研究的超越,应积极探索新的法律部门划分标准,承认民族教育法综合法律部门地位,这是由民族教育法本身的特性决定的,在一定程度上能促进传统法律部门理论的不断完善。
The construction of minority education law is an important part of China’s education, and it is also a key area of social development. As a basic law for minority education, the National Education Law can provide a theoretical basis for ethnic minorities to formulate relevant national education laws and regulations. With the continuous diversification of social relations, China’s legal department system has become increasingly complex, the legal department has been refining, and new fields with different characteristics of different legal departments have emerged. The issue of the status of national education law has become a hot topic for scholars. At present, the status of the National Education Law in the traditional legal departments of ethnic areas has two main views: subordination and independence. In order to better realize the status of the national education law, it should be explored in the traditional legal department. We should actively explore new legal departments. Dividing the standards and recognizing the status of the comprehensive legal department of the National Education Law is determined by the characteristics of the national education law itself, This promotes the continuous improvement of the theory of the traditional legal department to a certain extent.
