供给侧结构改革下我国乡村民宿发展现状及法律治理研究

Research on the Development and Legal Governance of Chinese Rural Homestay under the Circumstances of Supply-side Structural Reform

作为精准扶贫、农业供给侧结构性改革的新兴增长点,我国民宿成为乡村振兴战略的重要抓手。目前,乡村民宿的发展困境集中于:"强监管"与"放管服"之辩下监管思路有待厘清;OTA平台"乡绅责任"有待界定;源于消费者与乡村民宿服务提供者法律关系定性未决形成的司法失效。法律治理作为监管之重器应发挥其积极意义。具体而言,可以从"宏观-中观-微观"三个层面协同,形成以"政府-自律协会-个人"为"三原色"的法律治理体系,从制度层面实现对乡村民宿"法律监管"的稳定预期,进而实现法律保障下的供给侧改革。

As an emerging growth point of precise poverty alleviation and agricultural supply-side structural reform,rural homestay has become an important issue of rural revitalization.At present,the problems against the development of rural homestay include the debate between "proposing strong supervision"and "streamlining administration,delegating powers,and improving regulation and services".Like the squire in modern society,the responsibility of OTA needs to be defined.The unresolved legal relationship between consumers and rural homestay service-providers cause the judicial failure.Legal governance,a significant point of supervision should bring into its role of positive importance.To be more specific,it is reasonable to make macroscopic-mesoscopic-microscopic mutual promotion,developing a system of legal governance of which foremost element is the"government-selfregulatory association-individual".Therefore,it ensures that the stable expectation of"legal supervision"of rural homestay can be accomplished from the institutional aspect.And then it will achieve the realization of Supply-side Structural Reform under the protection of law.
