摘要
共享经济潮流下,网约车的用工关系颠覆了工业时代以生产为中心的稳定雇佣思维,凸显了传统劳动法"从属性"标准的"盲区"。在不打破现行法律规定的前提下,探索经济依赖型劳动者语境下之要素考察模式是解决矛盾的可能路径。此外,营造良好的劳动法制生态氛围,寻求劳动保护弹性与安全的平衡、完善社会保障体系和工会组织也是网约车用工法律规制的现实出路。
Following the trend of sharing the economy,the online car booking service employment relationship has subverted the stable employment thoughts of production-oriented relationship in the industrial era,highlighting the"blind zone"of the traditional"Attribute"standard of labor law.Under the premise of not breaking the current legal provisions,exploring the factor investigation mode in the context of economically dependent laborers is a possible path to resolve contradictions.In addition,creating agood ecological atmosphere for labor legal system,seeking a balance between flexibility and security of labor protection,and perfecting the social security system and labor unions are also the practical ways to legally regulate the employment of online car booking service.
