北京市卫生计生行政处罚裁量基准制度的适用性分析

Applicability Analysis of Beijing Health and Family Planning Administrative Penalty Discretionary Benchmark System

目的完善北京市卫生计生行政处罚裁量基准,在发挥裁量基准效力的同时实现规制行政处罚栽量权。方法通过实际执法数据以及对应用中存在问题的总结,研究行政处罚裁量基准。结果北京市卫生计生行政处罚裁量基准在建立、实施中存在评估不足、条款应用僵化、更新不及时等问题。结论从优化制定程序、强化监督管理及完善评估机制三方面来研究探讨,可以对北京市卫生计生行政处罚裁量基准制度做出适用性分析。

Objective To improve the standard of administrative punishment of health and family planning in Beijing, and to realize the power of administrative punishment.Method Through the aetual law enforcement data and summaries of the problems in application,the administrative penalty discretionary benchmark was studied.Result There were some problems such as insufficient evaluation,rigid application of terms,and late update in the establishment and implementation of the administrative punishment standard of health and family planning in Beijing.Conclusion The purpose of this study was to optimize the procedures,strengthen the supervision and management and improve the evaluation mechanism.
