摘要
现行法律对送达有效的严苛规定严重制约了司法办案效率的提高,以邮寄送达代收有效而开庭审理的案件进行实证分析,论证邮寄送达代收的法律缺位及司法实践的迫切需要,将邮寄送达代收有效的构成要件明确增加"受送达人户籍地址"、"成年人代收",这一立法建议可以节省送达成本、提高审判效率、树立司法权威。
The existing law seriously restricts the validity of delivery,and affects the judicial efficiency. This article explains the effective delivery of mail through court cases. Explain legal vacancy in other people’s collection by mail.Add to"residence address"," Adult Collection ",the legislative proposals can save the cost,improve the service efficiency of trial,and build judicial authority.
