摘要
从法制到法治 ,是世纪之交中国法学研究的重大突破和法治发展的历史性飞跃。从法制到法治的转变 ,要求我们加深对两个概念内涵的研究和探讨 ;法制侧重于静态的制度描述 ,法治则追求法的理念、精神和原则 ;法制的价值取向不明 。
The research of law in China from legal system to ruling by law is a important breakthrough and historic jump in its development. The transformation from legal system to ruling by law requires us to deepen the research of the connotation of two concepts.Legal system lay special emphasis on the static description,while ruling by law explores the concept,spirit and principle of the law.The value of legal system keeps unknown,whilethe value of ruling by law perseveringly pursues purw justice.
