摘要
债权人代位权作为我国合同法所确立的一项债权保全措施 ,将在保护债权人权益方面发挥重要作用。通过对债权人代位权的概念、法律性质和成立要件及效力的分析和探讨 ,就债权人在行使代位权中应注意的问题 ,提出自己的意见 ,希望为债权人行使代位权提供思路和借鉴。
The creditor′s right of subrogation,a protective measure for the creditor′s rights established in China′s contract law,will play an important role in protecting the creditor′s rights.The present paper,analyzing and exploring the concept of the creditor′s rights of subrogation,its legal nature,tenable requirements and effects,puts forward some suggestions concerning what the creditors should pay attention to while exercising their rights of subrogation.It is hoped that the creditor can gain some enlightment from these suggestions while exercising their rights of subrogation.
